The law firm MJH Moskwa, Jarmul, Haładyj i Partnerzy – Adwokaci i Radcowie Prawni spółka partnerska advised on the process of obtaining concentrations approvals, the purpose of which was to enable the acquisition of the assets of RAFAKO S.A. in bankruptcy.
In the first phase of the project, MJH represented a consortium consisting of Agencja Rozwoju Przemysłu S.A., Polimex Mostostal S.A. and Towarzystwo Finansowe „Silesia” sp. z o.o. in proceedings before the President of the Office of Competition and Consumer Protection (UOKiK) concerning the establishment of a joint venture – ARP Doradztwo sp. z o.o. (currently: RFK sp. z o.o.).
In the next stage, the law firm represented RFK sp. z o.o. in proceedings aimed at obtaining the consent of the President of the Office of Competition and Consumer Protection (UOKiK) for the lease and acquisition of key assets of RAFAKO S.A. in bankruptcy.
On 27 June 2025, RFK sp. z o.o. signed an agreement with the trustee in bankruptcy of RAFAKO S.A. in bankruptcy for the lease of part of the company's assets, including both real estate and production hall equipment, such as machinery, tools and devices.
The project was led by Dr Katarzyna Karasiewicz (partner) and Joanna Koterbska (senior associate), under the supervision of Dr Krzysztof Haładyj (partner).
